TERMS AND CONDITIONS of participation in tours and services organized by Poland Tour
- Service
- Poland Tour is a licensed tour operator (n# 1689) organizing tours in Poland. All our tours are carefully prepared and consist of accommodation, full board or half board, transportation in Poland, guides and all fees included. Detailed description of our tours and prices is presented at our website www.polandtour.pl
- Poland Tour reserves the right to change the price of a tour in case of proven increase of transportation costs or change of exchange rate but no more than 10% of the whole amount. Nevertheless this change can not be introduced later than 20 days prior to the starting day of the selected tour about which the Clients would be informed either by e-mail or fax.
- The Client is obliged to provide Poland Tour with all necessary information stated in the Booking Form and additional documentation if need, all within stated time. Default of this condition may result in cancellation of a booking with all consequences defined in point 5.
- Insurance
- Poland Tour could cover on request the Client by insurance against any risks that could occur during the whole period of her/his tour in Poland according to the dates stated on the Booking Form.
- The insurance may also cover additional days that the Client should decide to stay in Poland before or after her/his chosen tour. The insurance does not cover however the Client's travels to and from her/his place of origin. This kind of insurance could be purchased separately by the Client herself/himself.
- Signing the Booking Form, the Client announces that her/his physical and emotional capabilities enable her/him to participate in the chosen tour.
- The cost of insurance per person equals to 2% of value of a selected tour.
- In case of any claims resulted from the insurance, the Client should contact directly the Insurance Company within 7 days from the last day of the tour.
- Bookings, confirmations and payments conditions
- The booking is valid only when the Client has received Poland Tour's confirmation - a Booking Form that must be signed by the Client and sent back to Poland Tour, as well as when 50% of the whole amount of payment for selected tours has been received by Poland Tour's bank account.
- The Booking Form and the deposit defined in point 3a must reach Poland Tour's bank account within 7 calendar days from the date of confirmation of booking.
- Full payment for ordered services should reach Poland Tour's bank account not later than:
- 24 days prior to the starting day of the selected tour for individual travelers
- 30 days prior to the starting day of the selected tour for groups
- If a booking is made less than:
- 24 days prior to the starting day of the selected tour for individual travelers
- 30 days prior to the starting day of the selected tour for groups
- Payment shall be made to Poland Tour's bank account in accordance with the Booking Form.
- The Client should cover possible bank transfer fee, in order the whole amount of payment would reach Poland Tour's bank account without any deduction.
- Poland Tour reserves the right to cancel a booking in case of lack of payment or lack of signed Booking Form.
- Children Discounts
- Children under 4 years of age are granted free participation in our tours unless they get a separate bed and meals and if accompanied by a full paying adult.
- Children of 4-12 years of age are granted a 10% of discount on the total tour cost if accompanied by a full paying adult.
- Changes and cancellations
- Poland Tour should be informed about any changes and cancellations immediately by e-mail or fax.
- Changes and cancellations must be sent to Poland Tour in writing.
- Changes and cancellations of bookings received by Poland Tour prior to commencement of services will involve no costs to the ordering party if they are made no later than 30 days both for groups, individual travelers, programs on request and transportation services.
- If the cancellation is made between:
- 29-21 days prior the starting day of the selected tour the cancellation fee will be 20% of the whole tour price.
- 20-15 days prior the starting day of the selected tour the cancellation fee will be 50% of the whole tour price.
- Less than 15 days prior the starting day of the selected tour the cancellation fee will be 80% of the whole tour price.
- Changes of the personal data are free of charge only if they are made not later than 15 days prior the starting day of the selected tour. If they are made less than 15 days prior to the starting day of the selected tour the change fee will be 5% of the whole amount.
- Poland Tour reserves the right to cancel a tour if there are fewer Clients than requested minimum defined in point 9a. In case of a cancellation caused by Poland Tour, the Client would be informed by e-mail/fax/phone immediately. In these circumstances the Client would be offered full cost refund or other tour for the additional surcharge or reimbursement in a difference of the price. In virtue of a tour's cancellation the Client is not entitled to any compensation.
- In case the service is not delivered according to the description in the agreement, Poland Tour obliges to organize an alternative service. The vicarious performance of an alternative service should have the same or higher standard and can not be a case of any claims the Client could have against Poland Tour.
- Poland Tour's responsibility
- Poland Tour undertakes the responsibility for a careful preparation and organization of services paid by the Client. Poland Tour is also responsible for a non-performance or part performance of services these are caused by an action or abandonment from the part of a Client or a vis major.
- Poland Tour does not offer any refunds of tour's prices and values of particular services in which Client did not participate in full or part and resulting from the following: a) negligence from the part of a Client ex. being late in the meeting point, abandonment of part of meals, voluntarily renunciation of a part or a full tour b) resulting from a decision of government authorities or other vis major.
- In case of the inconveniences described in point 6b above, all additional costs are responsibility of the Client (i.e. homecoming costs, accommodation costs etc.). The Client shall not have any claims of compensation against Poland Tour.
- Poland Tour is not responsible for stolen, lost or damaged luggage resulting from a fault of the Client.
- Poland Tour will not be responsible for any losses or additional expenses made by Client due to causes beyond its reasonable control and resulting from vis major.
- Poland Tour is not responsible for interminable issue or refusal of passports or visas. The Client must cover all costs of passports and visa issues separately.
- Client's responsibility
- The Client is obliged to obey all rules and directions of Poland Tour's employees concerning an organization of program and order during a tour. Default of above directions may result in immediate discharge of the agreement with consequences defined in point 7b.
- Poland Tour reserves the right to discharge the agreement with the Client immediately without any financial consequences in case the Client is blatantly or insistently breaking the rules or his/her behavior is not compliant with customarily accepted values. Under these circumstances no refund shall be due in respect of any unused portion of a tour.
- The Client is responsible for all damages done by her/his own fault during the whole tour and is obliged to compensation for damages in place where they happened from her/his own means. For all damages caused by children are responsible their guardians.
- Complains
- In case the Client would notice any discrepancy between service given and offered, the Client should immediately inform about it a Poland Tour representative in order to enable him/her to mend that failure. If the Client is still unsatisfied, he/she should report this fact to Poland Tour office in writing within 20 calendar days from the end of the tour.
- In case Client's claims are acknowledged as reasonable, Poland Tour would compensate a loss made to Client in the amount proportional to the loss. However the value of the recompense can not exceed 120% of costs of bought tour.
- Other conditions
- The minimal requirements to start a tour are: 9 people participating in the same tour for 4 day tour and 15 people participating in the same tour for longer tour.
- A group booking shall mean a booking made for 15 people taking part in the same tour at the same time.
- In a group booking every 21st participant is free of charge in a double/twin room with all services included.
- Jurisdiction
- This Agreement is prepared in accordance with the Polish laws.
- In all matters not regulated by this Agreement the laws of the Republic of Poland apply and should be arbitrated by courts adequate for the Poland Tour's seat.
